Missing luggage: Court orders Emirates Airlines to pay Nigerian $1.36m, N50m

Justice Muslim Hassan also ordered Emirates Airlines to pay Ikem N50million as damages for the “untold hardship and loss of earning” he suffered by the deprivation of use of his money from 2007 till date.

The judgment followed the plaintiff’s nearly 12 years battle to recover two hand luggage containing personal effects and $700,000, as well as $930,000 in 18 bundles of $50,000 wraps each and $30,000 cash not in wrap.

The court heard that the $930,000 belonged to another businessman, Olisaemeka Ugwunze, who wanted it delivered in China for purchases.

The plaintiff told the court through his counsel, Chris Ekemezie, that at the departure lounge of the Murtala Muhammad International Airport Ikeja, Emirates Airlines staff requested that he handed the luggage to them for safe keeping in the cockpit, but he refused and insisted on keeping them himself.

They insisted on keeping the luggage for him considering the huge amount of money contained therein and that on arrival destination, the two bags would be handed over to him.

After a prolonged argument and in order not to miss his flight he yielded and handed over the two hand carry-on bags to them, and they were tagged with tag numbers EK428682 and EK428683 respectively.

That was the last time he saw the bags and the money. On his arrival in Guangzhou, the airline could not account for his four pieces of luggage.

Ruling on the plaintiff’s prayers for the return of the $1.36m and N100m general damages, Justice Hassan observed that the airline, through its counsel Prof Awah Kalu SAN, failed to refute Ikem’s claims.

The judge held: “I have read all the processes filed by both parties as well as their agreements and resolved that the only issue for determination is whether the plaintiff is entitled to the reliefs sought before this court.

“A claim not controverted is deemed admitted, in this case the defendants did not call witness but rather rests it case on that of the plaintiff which mean that all what the plaintiff claimed and their pleadings are admitted.

“I hold that Emirate Airlines failed in his obligations to customer by not delivering the luggage containing the sum of $1.36m.

“On the whole I hereby make the following orders; an order that Emirates Airlines pay the plaintiff the sum of $1.36m.

“An order that the defendant pay the sum of fifty million Naira (N50m) to the defendant as damages.

“Parties shall bear their own respective costs.”

Ex-Nigerian Minister Arrests Hotel Staff, Strip Them Naked For Allegedly Stealing N5,000

The four staff, it was learnt, were granted bail on Monday through the intervention of some anti-corruption and human rights activists, who decided to take up the matter.

A former Minister of State for Education, Kenneth Gbagi, who is currently nursing a governorship ambition in Delta State in 2023 on the platform of the Peoples Democratic Party, has arrested and charged four of his staff working in his hotel to court for allegedly stealing his N5,000,

It was reliably gathered that Gbagi last week Friday arrested the four staff working in Signatious Hotel, Warri, Delta State, after they were striped naked and photographed inside the hotel before handing them over to the police.

Our correspondent gathered that after dehumanizing the four staff, a male and three females, they were taken to the Ebrumede Police Station to be remanded in custody.

Speaking in confidence with our correspondent, a staff of the hotel revealed that his colleagues were arrested by the former minister over the alleged theft of the said amount.

He said, “My boss, former Minister of State for Education and owner of Signatious Hotel, Chief Kenneth Gbagi, arrested four of my colleagues working for him over the stealing of N5,000 from the hotel when actually the N5,000 was given as a gift to them by a guest because of their good behaviour.”

While giving the names of the arrested colleagues as Gloria Oguzie, Victor Ephraim, Rosslyn Okiemute and Achibong Precious, the source said, “Before they were arrested by the police on Friday last week at the hotel, the four staff were stripped naked while they were photographed in the presence of the police.

“We learnt that the dehumanising treatment was instructed by our boss.”

It was further gathered that the hotel management forcefully made some withdrawals from the bank accounts of the four staff through their ATM cards before the police took them away in a waiting van.

The four staff were charged before a magistrate court sitting in Effurun after four days of detention.

In a five-count charge, the police accused the suspects of conniving among themselves to steal monies ranging from N156,000, N110,000, N5,000 and N2,000 owned by Signatious Hotel and committed an offence punishable under section 516 and 390 (9), of the criminal code Law Cap21C Vol.1 Law of Delta State.

Warri-based human rights lawyer, Omemiroro Maxwell Ogedegbe, who confirmed the story, said that the four staff were granted bail by a magistrate court sitting in Effurun, Delta State.

Ghanaian lady who goes by the name Comfort spent 15 Million Naira (€31,000) out of 52 Million Naira (€90,000) that got transferred to her account by mistake instead of (€9,000) in a single day. The transfer was made by a Manchester charity store in Uk, it was supposed to be a refund to the lady Comfort but the store made a mistake with just one zero.

According the BBC North West, Comfort is a cleaner in United Kingdom and she is described as a very hard working and diligent woman but it’s a sad thing to note that greed got the best of her. An error was made quite alright by the charity store but instead of Comfort to call the attention of the store to the error made, she went on to buy expensive things and even went as far as sending money to her friends and family in Ghana where she hails from.

BBC North West declares that the police are already on the case in pursuit of the stolen money and with the hope of getting it back. As for Comfort, the act she carried out was considered as an offense and for this, she has been sentenced to 15months off work. It’s such a pity that Comfort took advantage of the situation without thinking about the repercussions.

Nigeria: Police Allegedly Torture 20-Year-Old Lady to Death in Karu

Lafia — A policeman Alpha Lamurde has allegedly tortured 20-year-old, Bilkisu Ummi Isa to death.

The incident happened on Calvary Road by Bola Police Outpost in Maraba, Karu Local Government of Nasarawa State.

Isa was alleged to have been tortured for a whole day and was granted bail when she started vomiting blood on Sunday.

Her brother, Zakariya Isa, said, her former boyfriend called Abdul was alleged to have stolen N1.4 million in the Car Dealership Center where he was working for a Lebanese Man, Jafar in Maitama, Abuja and absconded.

He said that, the friend of the runaway Abdul mentioned her name when he too was tortured.

Zakariya Isa said that the police arrested, beat and hit her head on the wall, and later called her parent to take her when it was realised that she was fainting.

But according to a friend of the deceased, Rukayya Muhammad, “A youth called Jibrin and a vigilante popularly called Master was alleged to have been commissioned to trace the suspect, Abdul, when he could not do so, he brought some vigilante to invite me as a friend of the deceased and the deceased to Calvary Road Police Station.

“The Inspector slapped, flogged and hit Bilkisu, but he gave me his number, that he like me, he spared me, told me to call him to meet him in a hotel and gave me his GSM number 07065743117. When I used a Truecaller, it gave his name as Alpha Lamurde, while his WhatsApp bears his picture.

“When I told him that she has fainted, he poured water on her. We were arrested and bailed by our parents on Monday. Bilkisu died on Sunday,” said Rukayya.

Malama Hadiza Isa who is the mother of the deceased said, ” I am appealing for support from the general public for those that led to the death of the lady to be brought to justice.”

The Police Public Relations Officer in Nasarawa State Police command, ASP Ramhan Nansel said, “The command is not aware of this incident but, we will investigate” he said.

But he later said, ” The above story is not the truth. I just spoke with the DPO now. The incident happened in a car dealership in Maitama Abuja, The Abdul in question took the ATM card of his boss who so much believed and trusted him then, ran to Calvary road.

“The Lady in question was also in the house when the police stormed the house. When the case was reported, police swung into action and arrested his friend who was accommodating the suspect, a search was conducted where the said ATM card and other valuables belonging to the suspect’s boss were recovered from his house.

“The DPO told me that, when rumours started filtering into his ears, he contacted the parents of the lady and they confirmed to him that the lady has been sick for long. The lady was neither detained nor tortured as claimed” said ASP Nansel.

When contacted on this number, 07065743117 the policeman said he doesn’t know anything about the allegation.

He later called and warned, “Journalists should learn how to do their work the right way.”
