Court Dismisses APC’s Certificate Forgery Suit Against Obaseki

A Federal High Court sitting in Abuja has dismissed the alleged certificate forgery suit filed against the governor of Edo State, Godwin Obaseki.

Justice Ahmed Mohammed dismissed the suit filed by the All Progressives Congress (APC) and a chieftain of the party, Williams Edobor, against the governor, in a judgement delivered on Saturday in the nation’s capital.

The APC and Edobor had filed the suit alleging that Governor Obaseki presented a forged certificate to seek re-election in the Edo State governorship election held on September 19, 2020.

According to the plaintiffs, the said document was purportedly issued by the University of Ibadan, while the governor presented same to Independent National Electoral Commission (INEC) which conducted the poll.

In his judgement, Justice Mohammed held that the plaintiffs relied on the photocopied document presented by Governor Obaseki without getting in touch with the university to verify the authenticity of the said certificate.

He added that no iota of truth was brought before the court by the plaintiffs who alleged forgery, saying it was a criminal matter, but the claimants were unable to prove their case.

The judge noted that the Deputy Registrar (Legal) of the University of Ibadan had given evidence in the suit that the university duly issued the certificate to Governor Obaseki.

According to him, the governor was duly and properly admitted to study Classics which was later renamed Classical Studies in 1976 and graduated in 1979.

Justice Mohammed concluded that the plaintiffs failed to prove their allegations of forgery against Governor Obaseki and, thereby, dismissed the case.

He, however, did not award any cost against the plaintiffs.

Before the judgement was delivered, counsels to both parties in the matter had closed their cases after they presented witnesses and evidence to the court.

During proceedings on Thursday, lawyer to the Plaintiffs, Akin Olujimi, adopted his final written address.

He urged the court to affirm their position that the governor presented a forged certificate to the electoral umpire and was unfit to occupy the office.

This was, however, rejected by Governor Obaseki’s counsel, Ken Mozia, who asked the court to dismiss the suit over what he described as the plaintiff’s failure to prove their case.

Governor Obaseki contested and won the governorship election on the platform of the Peoples Democratic Party (PDP), in a bid to extend his stay in office by another four years.

Although he was elected into office for the first term on the APC platform, the governor later defected from the party after he was screened out from the party’s primary which saw Mr Osagie Ize-Iyamu emerging as the APC flagbearer for the election.

This came in the middle of a lingered dispute between the governor and his predecessor and immediate past APC National Chairman, Adams Oshiomhole.

After defecting from the APC, he got the PDP’s ticket and went ahead to defeat Ize-Iyamu for the second time to claim the governorship seat in what can be described as a dramatic switch of political parties.

Governor Obaseki had defeated Ize-Iyamu as the APC candidate in the 2016 governorship election while the latter was the PDP candidate.

Four years later, he secured 307,955 of the total votes, 84,336 more votes than Ize-Iyamu who got 223, 619 votes

APC vs Obaseki: Primate Ayodele reveals who will win certificate forgery case

The leader of INRI Evangelical spiritual church, Primate Elijah Ayodele has revealed how the alleged certificate forgery suit by the All Progressives Congress, APC, seeking to sack the Governor of Edo State, Godwin Obaseki would end.

DAILY POST reported earlier that Obaseki, the APC and the Peoples Democratic Party (PDP) will on January 9 know their fate In a suit seeking to remove the Governor from office.

The APC and a chieftain, Williams Edobor, want the governor kicked out for alleged certificate forgery.

Justice Ahmed Ramat Mohammed of the Federal High Court, Abuja, fixed Saturday for judgment after lawyers to the parties adopted their written addresses.

Ayodele, in a statement to DAILY POST on Friday, said Obaseki is God’s project and no matter what, God will make him come out victorious in the battle.

He explained that Obaseki’s enemies cannot remove him through a court case.

“The governor of Edo State, Godwin Obaseki is God’s Project. His enemies can not remove him through court cases.

“He will overcome the court case ahead of him, His enemies won’t be able to pull him down now, He is God’s Project,” he said.

APC endorse Ali Modu Sheriff, Ex PDP chairman as New chairman

Ahead of the National convention of the All Progressive Congress (APC) a group known as the Vision for a Better Progressives and United Nigeria (VIPUN) has endorsed Alhaji Ali Modu Sheriff, former National Chairman of the People’s Democratic Party (PDP) to be the next chairman of the party.

The group, rising from a National Executive meeting convened in Owerri, the Imo State capital, on Tuesday, noted that APC needed ‘a dynamic, focused and self-willed leader that can galvanise and genuinely reconcile all members, stakeholders and interest groups ahead of the all-important 2023 general elections.

According to the National Coordinator of VIPUN, Peter Akubuo, who read the communique to newsmen, the APC has gone through a lot of upheavals in the last couple of years and thus the need for a unifying figure that can reposition it to remain on the winning ways.

‘You will agree with me that they were democrats and progressives, particularly those from the opposition parties that came through for the APC, when the party was at the verge of collapse, following the betrayal of some highly placed members of the party, who jumped ship at a very critical point,’ he stated.

‘One of the democrats that threw his weight behind the APC during those trying period, was the former National Chairman of the major opposition party, the People’s Democratic Party, Ali Modu Sheriff.

‘The former Governor of Borno State collapsed a major faction of the PDP into the APC and all the lawmakers loyal to him, defected to the APC, giving our party, the much-needed majority at the both Chambers of the National Assembly.

‘Sheriff has continued to work from behind the scene to keep the APC from collapsing,’ Akubuo stated.

The Governor of Ebonyi state, Governor David Umahi has formally defected to the All Progressives Congress, APC from the Peoples Democratic Party, PDP.

Umahi diclosed to newsmen in Abakaliki that he moved to the APC because of injustice metted out to the Southeast by the People’s Democratic Party (PDP).

He also said that he has no deal with the APC or any member of the party with regards to zoning of the presidential position to the southeast.

Hoodlum Hired To Attack #EndSARS Protesters Reveals Sponsors Goodluck Jonathan ‘Fooling’ Himself About 2023- Asari Dokubo

One of the suspected hoodlums hired to attack #EndSARS protesters in Abuja has naively exposed those that allegedly hired him and others to unleash violence on the demonstrators.

The hoodlum exposed their alleged sponsors on tape while having a chat with a man at the Unity Square, Abuja, where they had convened.

It was obvious from the viral social media video that the suspect did not know that he was being recorded.

The hoodlum, who revealed that he had once suffered SARS brutality, however, said that he agreed to the job because of the money they were promised.

“See wetin SARS do me for hand,” the suspected hoodlum said in pidgin English, adding that, “Na the money I dey follow na….God punish them (SARS)” when asked why he agreed to do the job.

Asked how much he was paid, he said: “them never pay, but them go still pay us, so far na them chatter our motor”.

Asked who chattered the vehicle that brought them, he responded: “They are around…na APC people na”

But when the person he was chatting with pressed him further to reveal the identity of the alleged sponsors, he said: “Both the PDP and APC are together.”

Some of the youths seen in the background of the video were carrying placards and wearing T-shirts with the inscription “we support SWAT”.

SWAT (Special Weapons and Tactics Team) is the new squad recently announced to replace the disbanded Special Anti-Robbery Squad by the Inspector-General of Police, Mohammed Adamu.

Ondo elections result: Gov Akeredolu in early lead

As results from the Ondo elections tickle in, it is evident that the current Governor, Rotimi Akeredolu, who is on the platform of the All Progressives Congress (APC) is in line to win a re-election.

Incoming results from polling units across Ondo state show that Governor Aberdour is in early lead beating Eyitayo Jegede of the Peoples Democratic Party (PDP) and Agboola Ajayi of the Zenith Labour Party (ZLP).

So far, results of 606 out of 3,000 Polling Units have been collated. Akeredolu currently has 65,590 votes, while his nearest contender Jegede has 40,027.  Ajayi has polled 11,603 votes so far.

The Peoples Democratic Party (PDP) has described the economic assertions in President Muhammadu Buhari’s independence anniversary speech as a huge slap on the sensibilities of Nigerians, noting the illogicality in the comparison of Nigeria’s fuel cost with Saudi Arabia’s.

In its reaction to the president’s national address to mark the 60th Independence Anniversary on Thursday, issued by Kola Ologbondiyan, National Publicity Secretary, the main opposition party charged him to “wake up to reality and take demonstrable urgent steps that will address the divisive tendencies and poor economic policies of his administration, which are fast decimating our dear nation under his watch.”

The PDP said Buhari’s attempt to justify the increase of fuel price in Nigeria by comparing it to the N168 per litre cost in Saudi Arabia “is a morbid joke,” noting that the minimum wage in Saudi Arabia is N305,113 (3000 Saudi Riyals), ten times higher than our paltry N30,000 which is largely unimplemented in Nigeria.

The PDP added: “Is Mr President not aware that, on the average, a person working in Saudi Arabia earns around 4,230SAR (N430, 267) to 16,700 SAR (N1,698,693) per month?

“Our party charges Mr President to always check his books before making such offensive comparisons including the price in Egypt where monthly average earning is around N222, 841 (9,200 EGP) against our N30,000.

“In comparing our costs with other countries such as Ghana, Chad and Niger where purchasing powers of citizens are much higher, did Mr President reflect on the cost of house rent, education, healthcare and average dependence on fuel for daily survival by ordinary citizens as obtainable in Nigeria?More in Home

“If the flawed assertions as evident in Mr President’s speech are a direct reflection of how policies are formulated in his administration, then one needs not to wonder why our economy is in the doldrums.

“Indeed, it is imperative to state that if the Buhari administration had summoned the competence and honest to continue the programs already laid by previous administrations under our party to revive our refineries and provide an infrastructural backbone for our productive sector, fuel price will not be more than N100 per litre, in addition to the gains from by-product from crude oil.”

The PDP, therefore, urged the president to engender harmony and productivity by allowing for more robust discourse that will lead to affordable prices for fuel and other essential commodities in our country.

It further posited: “Our party also holds as ludicrous that President Buhari is hyping his ‘better together’ theme when the administration he heads, runs on nepotism, disregard for rule of law, human right abuses, corruption, political intolerance, suppression of free speech and aggression towards dissenting voices.

“We urge Mr President to end his rhetoric and take practical steps to entrench the culture of rule of law and strengthen harmonious living through inclusiveness, equity in wealth distribution and equal access to opportunities for all Nigerians irrespective of creed, class, and ethnicity.

“Furthermore, credible elections are essential to harmonious living. Our party, therefore, restates our commendation to Mr President for his newfound commitment to non-interference in elections leading to conduct of free, fair and credible governorship election in Edo State on September 19.

“We urge President Buhari to toe the line of the Edo election in the October 10 Ondo governorship election so as to consolidate the legacy of a free and fair election under his watch.

“Additionally, Mr President should exert himself on rebuilding our economy by ending his borrowing spree and focusing on our productive capacity instead of his endless lamentation over his failures.

“Moreover, security is pivotal to our economic revival. The unceasing acts of insurgency, banditry and kidnapping in the last five years have wrecked our nation’s productivity and threatened her corporate existence.

“It is therefore worrisome that Mr President’s speech did not address the call on him by Nigerians demanding that he rejigs his security architecture to inject new blood that will effectively confront our security challenges.”

The PDP restated its belief in the potentials of the nation and urged President Buhari to seek help by engaging more competent hands to assist in handling the affairs of the country.

Things Fall Apart As Emeka Ihedioha’s Dream To Return As Imo State Governor Hits The Rock. (Details)

Things has indeed fallen apart for Emeka Ihedioha and his supporters as his hope of being returned elected has again hit the rocks.

The Supreme Court on the 13th of January nullified the election of Emeka Ihedioha of the Peoples Democratic Party (PDP) as the governor of Imo State.

The apex court declared Hope Uzodinma of the All Progressives Congress (APC) as the winner of the March 9th governorship election in the state. But since then, Emeka Ihedioha has being making moves on how to recover his supposed mandate from Hope Uzodimma.

The Recent move by Emeka Ihedioha to return as the governor of Imo state is with the law suit by RAP and its 2019 governorship candidate, Mr Kingdom Okeke. They approached the court seeking judicial interpretation on whether the All Progressives Congress (APC) indeed sponsored Mr Uzodinma in the 2019 Imo governorship election.

Mr Kingdom said the suit was predicated on the judgment of the Supreme Court which affirmed Uche Nwosu as the duly nominated 2019 Imo governorship candidate of the APC. He held that since Hope Uzodimma is not the candidate of the party, that his certificate of return should be withdrawn and issued back to Emeka Ihedioha.

The matter was adjourned severally and slated for a ruling today 29th of September until in a surprise move, Barr. Okere Kingdom issued a notice to discontinue the law suit against Governor Uzodimma Victory at the Supreme Court.

Before I end this article, i will like us to analyse the RAP Case.

The constitution provides for 14days for complaints arising from pre-election matter to be filed in court from the date of occourance of the event.

The Governorship primary of APC took place on the 20/10/2018. Neither of the parties challenging the election of senator Hope Uzodimma nor RAP filed any action within the time stipulated in the constitution to challenge the outcome of the APC primaries that brought Uzodimma as guber candidate of APC for the 2019 election.

The only pre election matter on the outcome of APC primaries that was filed in court was by Eze mmadumere before justice Orji of Imo state high court, who ruled in his judgment that Uzodimma was the rightful candidate of APC for 2019 governorship election. That judgment still holds sway till date and have not been appealed against or set aside till date. 

The heavy weather being created by RAP and It’s co plaintiffs Emeka Ihedioha is needless, on the following grounds;

(a).All the cases and issues of law being bandied around today are all election or post election matters.

(b) you cannot argue or raise pre election matters in an election or post election matter. Doing so is contrary to the provision of the constitution and amounts to illegality which the courts will not condone.

(c) the current players do not have the right to challenge the outcome of that primary and even where such right exist, time within which it can be constitutionally exercised has been closed permanently. Not even the supreme court can open it.it will require the amendment of the constitution which is not possible. “Equity aides the vigilant not the indolent”, it is trite also that “where the law stipulates a manner in which a thing must be done, failure to follow the procedure renders anything done illegal and void”, the rebut table presumption of compliance with due process or of candidature of distinguished Senator Uzodimma as APC guber candidate is in favor of Uzodimma and APC there being no proper suit that challenged that in compliance with the constitution.

Although this issue were argued at the supreme Court for the first time by counsel to Ihedioha and the PDP Barr. Ikpeazu SAN and justice Amina in response stood down the case and corrected the wrong impression ikpeazu had and to effect that the supreme Court did not make any pronouncement on his clients nomination.

Similar issue was also raised during the review by idowu panje counsel for AA and Uche Nwosu in response again justice AMINA requested him to choose between the matter under review or the issue of nomination upon which she would strike out his suit thereon if he chooses the later and idowu apologised, withdrew his application on the nomination and candidacy of his client Uche Nwosu against Uzodimma and ruling was made on in thereon.

In conclusion and in the popular legal parlance,” you cannot put something on nothing and expect it to stand” the foundation of all these heavy weather creating applications are defective of the constitution and would definitely face striking out by the court even if Mr Kingdom did not discontinue it.

APC Suspends Buhari’s Aide, Tinubu’s In-law As Crisis Deepens

The crisis rocking the All Progressives Congress, APC in Ekiti state has seriously deepened with the recent suspension of 12 party chieftains.

The Presidential Adviser, Senator Babafemi Ojudu; son-in-law to Senator Bola Tinubu, Oyetunde Ojo; former governorship aspirant, Dr Wole Oluyede; Ayo Ajibade; Femi Adeleye, Chief Akin Akomolafe; Bamigboye Adegoroye; Olusoga Owoeye; Dele Afolabi; Toyin Oluwasola and Bunmi Ogunleye have all been suspended by the party.

This development was contained in a letter signed by Ekiti state APC Publicity Secretary, Ade Ajayi.
